Terms of Service
Last updated: June 1, 2025 · Effective: June 1, 2025
Introduction
These Terms of Service ("Terms") govern your use of CanadaPathway, operated by Latom Consulting Services ("we," "us," or "our"). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the platform.
1. What CanadaPathway Is
CanadaPathway is an information and organisation tool designed to help individuals understand and navigate Canadian immigration pathways. The platform provides:
- Immigration pathway eligibility assessment tools
- Step-by-step application checklists
- Document tracking and expiry management
- AI-powered Letter of Explanation review
- Express Entry draw tracking and alerts
- A marketplace connecting users to third-party RCIC professionals
CanadaPathway is NOT a law firm, NOT a licensed immigration consultant, and does NOT provide legal advice. Nothing on this platform constitutes legal representation or creates any solicitor-client relationship. IRCC makes all final decisions regarding immigration applications. We make no guarantees of immigration outcomes.
2. Eligibility
You must be at least 18 years of age to use CanadaPathway. By creating an account, you represent that you are 18 or older and that all information you provide is accurate and truthful.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at info@latomconsulting.com if you suspect unauthorised access.
You may not create accounts on behalf of others without their explicit consent, or use the platform to process immigration information for third parties on a commercial basis.
4. Payments and Refunds
Payments are processed by Stripe, Inc. By purchasing a paid plan, you authorise us to charge the payment method on file.
One-time purchases: Access is granted immediately and does not expire. No recurring charges apply.
Monthly subscriptions: Billed monthly in advance. You may cancel at any time through the billing portal. Cancellation takes effect at the end of the current billing period. You will not be charged for subsequent periods after cancellation.
Refund policy: We offer a 7-day full refund on all purchases. To request a refund, email info@latomconsulting.com within 7 days of your purchase date with your order confirmation. Refunds are processed within 5–10 business days.
Price changes: We reserve the right to change our pricing. Existing monthly subscribers will be notified at least 30 days in advance of any price change.
5. LOE Scanner — Acceptable Use
The LOE Scanner uses AI to analyse Letters of Explanation. You agree that:
- You will not submit letters containing deliberately false information
- You will not use the LOE Scanner to assist others in misrepresenting facts to IRCC, which constitutes fraud under Canadian immigration law
- You understand the AI analysis is informational only and does not constitute legal review
- You will not include sensitive personal identifiers (passport numbers, UCI numbers) in letters submitted to the scanner
Misuse of the LOE Scanner to facilitate immigration fraud will result in immediate account termination without refund.
6. RCIC Marketplace
CanadaPathway provides a directory of Regulated Canadian Immigration Consultants (RCICs) and facilitates lead introductions. We do not:
- Employ, represent, or warrant the services of any listed RCIC
- Guarantee the availability or responsiveness of any RCIC
- Take responsibility for the advice, conduct, or outcomes of any RCIC engagement initiated through the platform
The RCIC-client relationship is formed directly between you and the RCIC. Any fees paid to an RCIC are separate from CanadaPathway fees. Our $50 referral fee is charged to the RCIC, not to you. If you have a complaint about an RCIC, contact the College of Immigration and Citizenship Consultants (CICC) at college-ic.ca.
7. Intellectual Property
All content on CanadaPathway — including checklist content, UI design, written guides, LOE Scanner prompts, and platform code — is the intellectual property of Latom Consulting Services.
You may not copy, reproduce, distribute, or create derivative works from any platform content without our written permission.
IRCC forms, regulations, and official government content referenced on the platform remain the property of the Government of Canada.
8. Prohibited Conduct
You agree not to:
- Use the platform to provide immigration consulting services to third parties for compensation without proper CICC licensing
- Attempt to reverse engineer, scrape, or copy platform content or underlying systems
- Share account credentials with other users
- Submit false information in any platform feature
- Interfere with the security or integrity of the platform
- Use the platform for any unlawful purpose
Violation of these prohibitions may result in immediate account termination without refund and, where applicable, reporting to relevant authorities.
9. Disclaimer of Warranties
CanadaPathway is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.
Immigration rules, program requirements, and IRCC policies change frequently. While we work to keep our content current, we do not warrant that all checklist content, program information, or draw data is up to date at any given time. Always verify critical information against official IRCC sources at canada.ca.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Latom Consulting Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to: immigration application rejections, processing delays, financial losses resulting from reliance on platform content, or loss of data.
Our total liability to you for any claim arising from use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Edmonton, Alberta.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or platform notification. Continued use after the effective date of changes constitutes acceptance of the revised Terms.
